Idaho 67-5203(5) states, “The text of all documents published electronically in the bulletin shall be the official text of that document until the document has been published in the administrative code. Judicial notice shall be taken of all documents published electronically in the bulletin.” Online only, since 2010. Idaho 60-302(2) defines “Legal Materials” as: “(a) the constitution of the state of Idaho; (b) the Idaho session laws; (c) the Idaho Code; (d) the Idaho Administrative Code and the Idaho Administrative Bulletin; (e) reported decisions of the Idaho Supreme Court and Court of Appeals, and; (f) Idaho court rules.”

Idaho 60-303 states, (1) This act applies to all legal materials in an electronic record that is designated as official (ed. – emphasis added) under section 60-304, Idaho Code, and first published electronically on or after July 1, 2015. (2) This act applies to the following legal material in an official electronic record that was first published before July 1, 2015: (a) The Idaho administrate code for the years 2010, 2011, 2012, 2013, and 2014, (b) The Idaho administrative bulletin for the years 2010, 2011, 2012, 2013 and 2014.

Idaho 60-304(1) states, “If an official publisher publishes legal material only in an electronic record, the publisher shall (1) Designate the electronic record as official; and (b) Comply with sections 60-305 (ed. - authentication), 60-307 (ed. - preservation), and 60-308 (ed. - public access), Idaho Code.”

Idaho 60-304(2) states, “An official publisher that publishes legal material in an electronic record and also publishes the material in a record other than an electronic record may designate (ed. – emphasis added) the electronic record as official if the publisher complies with sections 60-305 (ed. – authentication), 60-307 (ed. – preservation), and 60-308 (ed. – public access), Idaho Code.”
